These Terms and Conditions ("Terms") apply to your use of approachitco.com (the "Site"). The Site is operated by Joshua Proch, a sole proprietor doing business as Approach I.T. ("Approach I.T.," "we," "us," or "our"), based in Pacific Grove, California. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

1. Using the Site

You may use the Site to learn about our services, read our content, and contact us. You agree not to:

  • Use the Site for anything unlawful or fraudulent

  • Submit false information, spam, or malicious code through our forms

  • Try to gain unauthorized access to the Site or interfere with how it works

  • Scrape or copy large parts of the Site for commercial use without our permission

2. Information on the Site

We work to keep the Site accurate and current, but the content is provided for general information only. Blog posts, guides, and examples are not professional, legal, or financial advice for your specific situation. Search engines, platforms, and best practices change often, so some information may become outdated.

3. Pricing and Quotes

Prices listed on the Site are starting prices or typical ranges and may change without notice. A price on the Site is not an offer or a binding quote. Your final price is set in a written proposal or agreement before any work begins.

4. Free SEO Audits

Free audits are offered as a courtesy and are for informational purposes only. They're based on publicly available data and third-party tools at the time of the review, and they don't guarantee any particular result. Requesting a free audit doesn't create a client relationship or any obligation for you or for us. We may decline or limit audit requests at our discretion.

5. Client Services

All paid services, including SEO, Google Business Profile management, web design, website maintenance, content writing, IT consulting, and network services, are governed by a separate written agreement between you and Approach I.T. If anything in that agreement conflicts with these Terms, the agreement controls.

6. No Guarantee of Results

We don't control Google or any other search engine, platform, or AI tool. We can't and don't guarantee specific rankings, traffic, leads, reviews, or revenue. Anyone who guarantees a #1 ranking is overpromising.

7. Intellectual Property

The Site's content, including text, graphics, logos, and design, belongs to Approach I.T. or is used with permission, and is protected by copyright and trademark law. You may share links to our pages and quote short excerpts with credit. Any other copying or reuse requires our written permission.

8. Portfolio and Third-Party Names

Our portfolio shows work we've done for clients, shared with their permission. Client names, logos, and websites belong to their owners. Names of platforms and tools such as Google, Squarespace, Webflow, Shopify, and Wix are trademarks of their respective owners. Mentioning them doesn't mean they endorse us.

9. Links to Other Websites

The Site links to websites we don't control, including client sites and tools. We're not responsible for their content, availability, or privacy practices.

10. Disclaimer

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Site will always be available, error-free, or free of viruses.

11. Limitation of Liability

To the fullest extent allowed by law, Approach I.T. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred U.S. dollars (USD 100). This section doesn't limit liability that can't be limited under California law.

12. Indemnification

You agree to defend and hold Approach I.T. harmless from claims, losses, and expenses, including reasonable attorneys' fees, that arise from your misuse of the Site or your violation of these Terms.

13. Privacy

Our Privacy Policy explains how we handle information collected through the Site, and it is part of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute related to the Site will be handled in the state or federal courts located in Monterey County, California.

15. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. Continuing to use the Site after changes means you accept the updated Terms.
